Announcer: | I’m with Stephanie Marentette from Cohen Highley Lawyers. To what extent is your personal data protected from being released to third parties? |
Stephanie Marentette: | Ontario businesses are obliged to protect customers’ personal data. In Ontario the Personal Information Protection and Electronic Documents Act, or PIPEDA, provides a framework for the obligations businesses have regarding customers’ personal information. |
Announcer: | What’s the gist of that framework? |
Stephanie Marentette: | The framework regulates the collection, use and disclosure of personal information. Put more generally, the collection, use and/or disclosure must be lawful and for purposes that are either expressly stated in the legislation or objectively reasonable. |
Announcer: | Are there circumstances business can be compelled to share this information outside of the scope of PIPEDA? |
Stephanie Marentette: | Yes. If a business is served with a Court Order, it would be required to turn over the information. Businesses can also voluntarily provide information requested by police or other law enforcement agencies without a Court Order under PIPEDA. |
