Announcer: | I’m here with Nicole Fillmore from Cohen Highley Lawyers. What are the two most commonly used Power of Attorney documents in Ontario? |
Nicole Fillmore: | A Continuing Power of Attorney for Property and a Power of Attorney for Personal Care. |
Announcer: | Start with the Continuing Power of Attorney for Property. |
Nicole Fillmore: | It allows your named substitute decision maker to manage your property and finances on your behalf while you are mentally capable and also allows them to do so if and when you become mentally incapable of doing so yourself. |
Announcer: | Okay, give an example of when a Power of Attorney for Property may be used while you are mentally capable. |
Nicole Fillmore: | Say you are out of the country but you need to sell a property or deal with an account in Ontario in your absence. Your substitute decision maker can assist with that. |
Announcer: | And the Power of Attorney for Personal Care? |
Nicole Fillmore: | It allows your named substitute decision maker to make decisions with respect to your personal care, including things like housing and medical decisions, but only when you are mentally incapable of doing so yourself. |
