Announcer: | I’m here with Stephanie Marentette-DiBattista from Cohen Highley Lawyers. What challenges exist during COVID-19 when it comes to litigation? |
Stephanie Marentette-DiBattista: | The biggest challenge is currently that the courts are closed and only hearing matters that are absolutely urgent and the Ontario government has suspended almost all limitation dates as of March 16, 2020. As a result you can expect delays in many civil litigation matters. |
Announcer: | So, no suing then? |
Stephanie Marentette-DiBattista: | Not necessarily. While the court is currently closed and unable to hear most matters or set most documents, lawyers still have options to help their clients. For example, a lawyer can help you start or defend an action by filing your materials online. It is also important to remember that even though most limitations are currently suspended, you should still respond to any claims as soon as possible. The same goes for commencing an action if you believe you have a problem that requires a legal remedy. |
