ANNOUNCER: I’m here with Ken Fraser from the Family Law Department of Cohen Highley Lawyers. Now, since marijuana is legal, what are the rights of a parent to smoke or actually use it around their children?
KEN: Canada’s recent legalization of marijuana isn’t really going to change the rules with respect to children. Decisions are still going to be made in accordance with their best interest. The fact that marijuana is now legal will not be determinative of such issues. The court’s still going to have to consider a number of factors like the children’s safety.
ANNOUNCER: Now and just to be clear, what does that mean?
KEN: Well, just like there is with alcohol, there’s going to be circumstances and situations where some consumption or use is going to be okay, but there’s also going to be situations where the amount consumed, how you consume it, or whether it’s consumed near a child, is going to make it unacceptable.
