BEN: Residential landlords in Ontario are responsible for maintenance, and yes, that includes snow and ice removal from common spaces. The Residential Tenancies Act, or the RTA, sets out rights and responsibilities of landlords and tenants. Residential leases cannot conflict with these provisions of the RTA.

ANNCR: What if the landloard creates a lease agreement that shifts the reponsiblility of snow and ice removal to the tenant?

BEN: It may be unenforceable, it could also increase the landlord’s risk of liability in the case of a slip and fall.
