Legal Moment: What happens if your injured by a motor vehicle driver without insurance?

ANNOUNCER: I’m with Matt Rynan from Cohen Highley Lawyers. What happens if you’re injured by a motorist without insurance?

MATT: Ontario car insurance policies have mandatory uninsured motorist coverage. So, if you’re injured by somebody without insurance or involved in a hit and run, your own vehicle policy will provide coverage. And if you don’t have car insurance, if you’re an uninsured pedestrian, for example, you can still tap into liability limits through the government’s Motor Vehicle Accident Claims Fund. This fund is a last resort option for situations where no other insurance policy options exist.

ANNOUNCER: Any other advice?

MATT: Yes. If you’re injured in a car accident and there are issues with coverage, contact a personal injury lawyer right away. The appropriate insurance company or the fund will need to be properly notified. You should also consider contacting your insurance broker to discuss increasing your policy limits. Typically, the costs of the increase are very small and you’ll be grateful for the extra coverage if you’re seriously injured.
