Does spousal support automatically end upon remarriage?

ANNOUNCER: I’m with Ken Fraser from Cohen Highley Lawyers. If someone that is receiving spousal support from a previous relationship remarries, does their spousal support automatically end?

KEN: No, that’s not the case. Unless there is a separation agreement outlining that spousal support is to end upon remarriage. There are no rules that would cause spousal support to automatically terminate upon the new marriage. Having said that, spousal support may end and there are many variables that need to be considered. Some examples of these variables include the length of time that the parties were together, the roles they each adopted during the relationship, whether there are any children, the ages of the children, and each of the parties’ respective financial positions.

KEN: It may also be necessary to review the amount of time that has passed since separation occurred and the financial circumstances of any new spouses.
