How is child support affected when there is a change in income?

ANNOUNCER: I’m here with Ken Fraser from Cohen Highley Lawyers. Say you are a payor of child or spousal support and your income drops. Are you able to decrease your support payments?

KEN: It will depend on why your income dropped.

ANNOUNCER: How so?

KEN: If you were laid off due to a lack of work in your field and had to take a job with lower pay, ran into a medical issue, or were dealing with a legitimate issue out of your control. The courts will often allow you to decrease your support payments in accordance with your new income level.

ANNOUNCER: But?

KEN: There are some circumstances such as quitting your job or actively taking a lower paying position when the courts will typically impute income to you. Which means you will still be required to pay your support payments based on your original income. And if you can’t afford those payments any longer, that’s your problem.
