Condo Rentals and Pet Owner Restrictions

ANNOUNCER: I’m with Stephanie Sutherland from Cohen Highley Lawyers. Can condo owners rent to pet owners?

STEPHANIE: It depends upon your condo’s governing documents. While the Residential Tenancies Act states landlords cannot prohibit pets, condo corporations can. So, if you rent a condo unit to a pet owner and the condo’s documents state there are no pets allowed, you have a problem.

ANNOUNCER: So, what happens?

STEPHANIE: Your tenant has to either get rid of their pet, which pet owners will rarely want to do, or you’ll have to end their tenancy.

ANNOUNCER: But evicting a tenant can take a long time, what’s happening to you, the condo owner, in the meantime?

STEPHANIE: Often, if the owner is actively taking steps to remove the tenant, the condo will allow the process to play out. But if the owner is ignoring the issue, the condo corporation could take the issue to the Condominium Authority Tribunal, which could grant a compliance order and potentially legal costs against the condo owner and the tenant.
