Mistakes Employers Make When Terminating Employees

CHRISTIAN: There are many potential pitfalls when terminating an employee, all of which can end up in a wrongful dismissal action. But I can share a few, failing to provide sufficient notice of termination or sufficient pay in lieu of notice is a big mistake.

ANNOUNCER: Now that’ll vary based on the factors we’ve talked about before.

CHRISTIAN: Exactly. Another is not providing an employee with sufficient time to review and consider the severance package or to obtain legal advice. Refusing to a reference can also cause problems.

ANNOUNCER: Now why would the employer give a reference?

CHRISTIAN: When it comes to avoiding a dispute, the sooner an employee can obtain a replacement position, the better for all parties. An accurate reference will obviously assist the employee in their job search.
