Care Home vs. Retirement Home?: You Better Know The Difference!

The Residential Tenancies Act, 2006 (the “RTA”) has special provisions governing the operations of “Care Homes”. Care Home operators may now also be subject to special regulation under the Retirement Homes Act, 2010 (the “RHA”). A landlord providing rental housing for seniors who receive specialized “care services” may be subject to three separate regulatory regimes: standard RTA rules; “Care Home” rules; and “Retirement Home” rules. Knowing which regulatory regime applies to which tenants is crucial to your risk management and operational compliance strategy.
