JOHN: First, it’s important to recognize that just because someone’s medical care did not deliver the outcome they hoped for does not necessarily mean there has been medical malpractice.
ANNOUNCER: What would be required to potentially justify a lawsuit?
JOHN: First, it must be proven that the doctor or nurse fell below the standard of care that is expected of a reasonable healthcare provider. The standard to be met is not perfection. The is was the care reasonable or was it negligent? If the care was negligent, it must then be proven that the negligence was the cause of a significant injury or death.
ANNOUNCER: Can you give me some examples of medical malpractice suits?
JOHN: There can be many possible cases or scenarios. Some examples would include misdiagnosis, delayed diagnosis, miscommunication, surgical errors, medication errors, or unnecessary surgery, just to name a few.
