CHRISTIAN: Although it’s a common belief that any employee can resign by giving two weeks notice without any further obligation, this isn’t always the case. The law recognizes that an employer may be entitled to more notice of an employee’s resignation.
ANNOUNCER: What are some of the things that can influence or play a role in this?
CHRISTIAN: It’s a question of how key the employ and how difficult it will be for the employer to replace them. Related to this are additional factors such as the employee’s level of responsibility and their length of service. Most people are familiar with the concept of wrongful dismissal, but what’s not as well known is that the opposite can apply. If an employee quits without giving reasonable notice, the employer may have the basis for a wrongful resignation claim.
