ANNCR: I’m with John Nicholson, a medical malpractice lawyer at Cohen Highley. John, what are some key elements for medical malpractice suits?
John: First – people should understand that unfortunate outcomes are realities in life and in medical care. They do not necessarily constitute medical malpractice.
ANNCR: And what does?
John: Two key criteria must be proven. One – that the doctor or nurse must fell below the reasonable standard of care – meaning they were negligent. And second – the plaintiff must prove that the negligence caused the negative outcome – like an injury or death.
ANNCR: What are some medical malpractice suit examples?
John: Medical negligence can occur in many ways. Misdiagnosis, delayed diagnosis, miscommunication, medication or surgical errors, unnecessary surgery…I could go on.
ANNCR: Final thoughts?
John: Medical malpractice cases are challenging to prosecute, and they are defended vigorously. The best advice I can give is to make sure the lawyer you’re dealing with is experienced in these types of cases.
ANNCR: Thank you, John. This has been your Cohen Highley Legal Minute.
