ANNOUNCER: I’m here with Ken Fraser from Cohen Highley Lawyers. If you are a child support payor and your child goes to university, do you have to continue paying?
KEN: Yes. However, the amount of child support that you’re required to pay and the way that it’s calculated will depend on a number of factors.
ANNOUNCER: Such as?
KEN: In addition to looking at your income and the number of children, there will also have to be a consideration of how many months the child lives at home, the child’s expenses while away from home, and the child’s ability to contribute to their own costs. This applies not only to university but to most forms of post secondary education.
ANNOUNCER: Understood. So, say the child is away at school for eight months and at home for four months.
KEN: While each situation will depend on its own particular circumstances, in some cases a decision may be made to average child support payments over the course of the year.
