ANNCR: I’m with Vera Dokter from Cohen Highley Lawyers. Vera – what is the “Tarion New Build Agreement Registration”?

Vera: As of July 1st, 2025 – new freehold home purchasers must provide notice of purchase within 45 Days of acceptance to Tarion – an independent, not-for-profit consumer protection organization designated by the provincial government to administer the Ontario New Home Warranties Act.

ANNCR: Does it cost anything for the registration?

Vera: The registration is free and can be done online – the change was implemented to protect new home buyers’ deposits under the Tarion Deposit Protection Program, while allowing Tarion to monitor illegal building and selling of new homes.

ANNCR: And what is the deposit protection program?

Vera: It provides protection for the buyer’s deposit made to the home builder on execution of the agreement. Starting January 1st of 2026, if you don’t register within 45 days of acceptance, you will still be covered by Tarion, but you may receive a reduced amount of deposir protection coverage.
